This Injunction was issued after the court upheld Apple’s patent infringement claim concerning one specific patent – EP 2059868 – which outlines an interface for viewing and navigating photographs on a touchscreen phone.
Although, this is a Europe-wide ban, but it will only be valid in countries when Apple has taken the pain to get the aforementioned patent locally registered, which include Germany, Ireland, Sweden, Switzerland, UK and Netherlands.
As the patent in question is a software patent, Samsung can still salvage the situation by offering a software patch for these devices, which will change the interface of gallery app to remove the infringing parts.
“With regard to the single infringement cited in the ruling, we will take all possible measures including legal action to ensure that there is no disruption in the availability of our Galaxy smartphones to Dutch consumers.”
