Court asks Samsung to give samples of Galaxy S2, Tabs, Infuse 4G, Droid charge to Apple

A Federal Court has asked Samsung Electronics to provide early samples of its upcoming Android smartphones and tablets to Apple as the part of ongoing legal dispute between the companies. Court has given this order to provide Apple time to file early injunction to stop the sales of these device if deemed necessary.

To remind you, Apple sues Samsung last month and called Samsung Galaxy S and Tab as the copies of its iPhone and iPad.  While court still isn’t endorsing Apple’s claims, but it found merit in Apple’s arguments.

“In particular, the design and appearance of Samsung’s forthcoming products and packaging are directly relevant to Apple’s trademark, trade dress, and design claims. Because these claims are subject to consumer confusion and “ordinary observer” standards, the products themselves and the packaging in which they are sold are likely to be central to any motion for preliminary injunction,” the order reads.

Court has given Samsung 30 days to hand over product samples, packaging, and package inserts of Galaxy S2, Galaxy Tab 8.9, Galaxy Tab 10.1, Infuse 4G, and Droid Charge to Apple.




  1. so, if Apple finds out that it is indeed a copy of its product then the sales of these high end Samsung product will stop? If that’s the case then my intention of having this Superb Galaxy s2 phone will be hurt badly.
